Final disposal of Speak Asia case on 8th August, 2012

The following official communication from the SAOL Company which says that the final disposal of the case is expected on 8th August, 2012.

Dear Speakasians,

Yesterday was a very important day for us as our matter was heard by Hon'ble Supreme Court and we got a favourable response in the interest of all our panelists. We are happy to share that Honourable Court gave a patient hearing to our learned counsels and the other parties. The Hon'ble Court heard our plea that EOW is making baseless objections in sharing our data and we are not getting any cooperation from EOW in resolving the matter and disbursement of money which is already lying with the Registrar of Hon¹ble Supreme Court. Based on our pleas, the Hon¹ble Court directed EOW to hand over the data to the Hon'ble Court on the next date fixed as 8th August for final disposal.

This indeed is a great achievement as we are inching close to our victory. What normally takes years to achieve, we have been able to get in just 3-4 months. We will use this interim period to consolidate our position which should help in early resolution of our problems.

We would also like to point out that Mr. Navnit Khosla has been consistently pursuing the matter in one form or the other and in different forums despite AISPA members handling his claims and his affidavit in that regard before Hon¹ble Mumbai High Court. We fail to see his ulterior motive to derail the process of disbursement of money to panelists who have chosen to exercise the company’s exit option.

We would also like to share with you that we are taking legal opinion regarding early resumption of our business in India. We understand that some misguided people will try to spread panic and create doubts in the minds of our people. Also, do not give any of your personal details to any unauthorised person or on website which claims to be collecting data on behalf of the company.

SAOL - Supreme Court Hearing on October 17, 2011

October 18th,2011.


Dear Panelist,


The Honourable Justice Dalveer Bhandari of the Supreme Court strongly reprimanded the Ministry of Finance and the Reserve Bank of India, for not having filled the reply affidavit, to the written petition filed by the panellists of Speak Asia. Ministry of Finance and the Reserve Bank of India were supposed to file their reply on or before the 10th October 2011. Justice Dalveer Bhandari has asked Additional Solicitor general Kitit N. Rawal to ensure that both the respondents should file their affidavit before the next hearing. He also said that the casual attitude of the Government in this issue was very disturbing as it was the issue of the money and livelihood of so many people

Disposing before the bench of Justice Dalveer Bhandari and Justice Deepak Varma, Gopal Subramanian, senior council for Speak Asia explained the total business model of the company. He compared the business of Speak Asia to that of Ebay, where the consumer benefits most. He said this was a much better and refined version as the consumers not only got great deals but could also earn reward points that could be used to buy goods and services. He also emphasised on the training initiatives taken by the company. He lauded the extraordinary vision of the two Singapore based entrepreneurs and the unfortunate victimisation of the company

He urged the court to form a committee headed by Retd. Chief Justice R.C Lahoti, to facilitate the payments to be made to the panellists. He said that the company has the resources to complete all their obligations. He further added that the they have no problems with the ongoing investigations and had upmost faith in the law of the land. He also appraised the court on how the company has been harassed on the basis of some unsubstantiated media reports, and was pursuing legitimate business in the internet space which is the future of all business transactions


The council for the panellist Mr.Mukul Rohitgi urged the court for immediate relief for the panellist. The Supreme Court was most inclined to set up a committee to look into all the issues of the company and its panaellists


The Supreme Court has also instructed the CBDT and the EOW – Mumbai police who have the records of all the payments to be made party to the case, to be present for the next hearing which will be in the next two weeks.

The latest news about Speak Asia Online Pvt Ltd management reveals that the website www.speakasiaonline.com will resume its operations within next one or two days. As announced earlier, the exit option will be functioning when the original website is operational within the next few days.

The EOW (Economics Offense Wing) has made significant progress on the investigations last week. At any time, it is expected they will release a positive statement with a set of guidelines to be followed in order to continue the survey program. There are no clues about what are those conditions and every one is eagerly waiting for the final hearing.

After the announcement of exit option by the SAOL management, there are both positive and negative opinion from the panelists. Those panelist who are confident about SAOL's management, they say that once the operations are started with the modified policies (if applicable), the business growth may not be like the case earlier to the EOC incidence, but on a long run, this may not be a big problem to the SAOL's vision.

It has been noticed that many panelist has forgotten their  sponser id details as there is nowhere an email or any document issued to the panelist with the sponsor id information. Very good news to all ! ! ! As promised on 10th september 2011, Speakasiaonline Pte. Ltd. has started its exit option. Below is the official communication and details of the policy.

Exit Policy

In continuation of our exit policy notification of 1st August 2011, please find below the terms and conditions for the exit policy option to be availed. Since panelists have joined SAOL at different stages and time, the possible scenarios in case panelists chooses to EXIT will be as follows:

• NO Reward points (henceforth referred as RP ) earned after becoming a panelist:
If you have recently subscribed to the E-Zine and have not participated in the SAOL activities or no RPs have been credited in your account then you can opt out of your association with SAOL by agreeing to these terms and conditions and filling up the attached form. By doing so you will get refunded your entire subscription cost less the registration amount to your bank account mentioned in your profile. The e-zine subscription shall cease to be sent to your mail ID and you will no longer associated with SAOL.

• RPs Earned lesser than Subscription Cost:
In case you have en-cashed or used RPs, whose total value is less than the subscription cost, these RP's shall be deducted from the cost of Subscription and the balance will be credited in to your bank account. The ezine subscription shall cease to your mail ID and you will no longer associated with SAOL.

• RPs en-cashed or used are more than subscription cost:
You are welcome to participate in SAOL website since your participation has earned your RP's more than your subscription cost. You can now utilize the RPs for various revenue generating activities of the company once restart of our services is allowed in India.

In order to exit you are required to fill and submit the attached form. However in order fill the attached form, you will have to agree to the terms and conditions mentioned in this policy by clicking on the I agree button at the bottom of this page. Your details will be verified with the database in company's servers and a confirmation mail will be sent to you. This is subject to gaining access to the company servers from EOW Mumbai.

Amounts due to you will be sent by telegraphic transfer from Singapore and the company's amounts lying in the accounts of its master collection representatives of HVP in India. This is subject to getting an assurance from the RBI in India that these transactions will be allowed to be credited to your accounts in India. (Alternatively the company is also actively exploring the possibility of transferring the total amounts along with the list of recipients to either a designated court in India or a competent authority that the court may wish to appoint for this purpose.)

All the amounts lying with the company in Singapore are being legally reserved for making the payment to the panelist and cannot be used for any other purpose.

If the panelists EXIT, it is their sole responsibility to satisfy the queries raised by any of the authorities. Once the decision to EXIT is taken, it cannot be reversed. Any rewards due to the panelists who exit will not be processed and will not be contested by the panelists.

1. As lot of rumor is going on that the COO Mr. Tarak Bajpayee has been released on bail by Supreme court on 29/08/2011 is not true. We have authentic information from the official SAOL sources that nothing of that sort has happened. Though he is expected to get the anticipatory bail very soon which will stop all the arrest apprehensions from across India by various state police in similar cases.

2. The control of the website www.speakasiaonline.com is still not with the SAOL management so only panelists are facing problems which are pure technical in nature. There is nothing to panic because of website not being functioning properly because as soon as we get some relief on the battle field of the law correcting a website is peanut.

3. There are hearing of cases going on in various courts of laws in India related to SAOL and till now nothing has been proved against of Speak Asia in any court of law. Any learned person in India knows very well that any court would not deliver its judgement merely based upon negative campaigning by media against any entity. It will go through each and every fine detail of the facts before delivering the final judgement. Looking at the current scenario of SAOL case victory in court is sure but no one in this world can give a date.

4. Speak Asia Panelists Association (AISPA) has filed a PIL (Public Interest Litigation) before the Honorable High Court at Mumbai which is now posted for 7th September, 2011, when the Government of Maharashtra is to file its reply. Apart from this some of the panelists have independently moved the Honorable Supreme court and are in the process of filing a PIL before the Supreme Court asking for ad interim relief and requested that the money which is seized by the authorities in India be brought under the custody of the Supreme court and under its supervision be distributed among the panelists.

5. As per our official sources we can expect some critical and probably good news on the legal front in this week. So stay tuned with only reliable media and do not pay attention to rumors and for god shake you don't join the people who spread rumors for cheap publicity of themselves and play with the emotions of millions of innocent investors across our country.

Recent Update - Speak Asia Online

This is the first video message by Tarak Bajpai for all the SpeakAsians. The recent update is, Court has rejected the request of police to extend the custody. Mr Tarak Bajpai and other officials granted judicial custody for next 2 days. Bail application accepted by the court. Proceedings regarding bail hearing on 25th August. SpeakAsia lawyer had meeting with Public Prosecutor to end this on going problem for once and all. There will not be any arrest for any other complaints. We are still waiting for an update on the outcome of this meeting.

The Future plan of SAOL

After getting bail from Mumbai High court, Tarak Bajpai has taken some steps-
1. SpeakAsia has asked RBI again to permit the remittance of Payments (dated 19th August 2011)
2. He is already informed that the website will be hand over to SAOL management with in Few days.
3. Speak Asia is trying to get the YUG products from port.
4. Top leaders and the Speak Asia panelist associations are going to meet with Tarak Bajpai.
5. All panelist are awaiting for getting the due payments, that is why, SAOL management are trying to get the RBI, EoW clearance for PE, which is in LOOP.
6. Tarak Bajpai will give a positive news (via Presentation) to all panelist but he is awaiting for Green signal from the RBI and EoW. He is not allowed to organise any meeting or presentation right now.
7. Mrs. Haren and Manoj Kumar are planning to come back to India if her lawyers allow her to come back from Dubai.
8. They are not allowed to permit payout before PE.
9. No New Investigation is required by EoW, but they are expecting POSITIVE news from High Court.

BJP seeks FIR against Speak Asia accused for economic offenses

In the backdrop of reports of the alleged scam at the Singapore-based online survey company Speak Asia, the BJP today demanded the accused be booked for economic offenses. In a memorandum submitted to the Superintendent of Police of the Economic Offenses Wing (EOW) Manoj Singh, theMadhya Pradesh convener of BJP Investment Cell Mukesh Singh Rajawat said an FIR be registered against the company for the alleged fraud.
